Terms of Service

These Terms of Service ("Terms") govern your use of PH Livestock ("Baboy PH", "the platform", "we", "us", or "our"), a livestock listing service operating in the Philippines. By accessing or using the platform, you agree to be bound by these Terms in accordance with Republic Act No. 8792 (Electronic Commerce Act of 2000), Republic Act No. 11967 (Internet Transactions Act of 2023), and all other applicable Philippine laws.

If you do not agree to these Terms, you must immediately stop using the platform.

1. Platform Description and Intermediary Status

2. User Accounts and Eligibility

2.1 Eligibility

You must be at least eighteen (18) years old and possess full legal capacity to enter into binding agreements under Philippine law to use this platform.

2.2 Registration

To access certain features, you must create an account using a valid email address. You are solely responsible for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to keep it up to date. One person may maintain only one account. Creating multiple accounts to circumvent bans, rate limits, or other restrictions is prohibited.

2.3 User Roles

• Buyer (default): Browse listings, send inquiries to breeders, submit reviews, report listings or breeders, save searches, and manage favorites.
• Breeder: All Buyer capabilities, plus create and manage livestock listings, upload photos, and view listing analytics.
• Admin: Moderate listings, manage user trust levels, review reports, and enforce platform policies.

2.4 Account Suspension and Banning

We reserve the right to suspend, restrict, or permanently ban your account at our sole discretion, with or without prior notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or pose a risk to other users or the platform. Banned users may not create new accounts. Attempts to circumvent a ban will result in immediate termination of all associated accounts.

3. Listing Guidelines and Breeder Responsibilities

3.1 Listing Requirements

By posting a listing, you represent and warrant that:

• You are the legal owner of the animal or are duly authorized by the owner to sell it.
• The animal is real, currently existing, and available for sale at the time of listing.
• All information provided is accurate, truthful, and complete, including breed, age, weight, vaccination status, price, location, health status, and any known defects or health issues.
• All photos are real photographs of the actual animal being listed — not stock images, AI-generated images, or photos of other animals.
• The listing complies with all applicable Philippine laws, including RA 8485 and RA 10631 (Animal Welfare Act, as amended), RA 9296 (Meat Inspection Code of the Philippines), and all Bureau of Animal Industry (BAI) regulations.
• You have obtained or will obtain all required permits for the sale and transport of the animal, including BAI shipping permits where applicable.

3.2 Content Review

All listings are subject to review and moderation before publication. We reserve the right to reject, remove, or archive any listing at our sole discretion, with or without notice, for any reason including but not limited to violation of these Terms, applicable laws, or our content moderation policies.

3.3 Content Ownership

You retain ownership of all content you post on the platform (photos, descriptions, etc.). By posting content, you grant us a non-exclusive, royalty-free, worldwide license to display, distribute, and promote that content in connection with operating the platform. This license terminates when you delete or archive your content from the platform.

4. Prohibited Conduct

The following activities are strictly prohibited on the platform. Violations may result in immediate account suspension or permanent ban, and may be reported to appropriate law enforcement authorities:

• Fraud and scam listings: Posting fraudulent listings, misrepresenting animals, or engaging in estafa or swindling as defined under Articles 315–318 of the Revised Penal Code and RA 10175 (Cybercrime Prevention Act of 2012).
• Misleading information: False pricing, fabricated animal details, inaccurate photos, fake vaccination or health records, or deceptive breed claims.
• Protected and endangered species: Listing any wildlife species protected under RA 9147 (Wildlife Resources Conservation and Protection Act) without proper DENR Wildlife Farm Permits and documentation.
• Animal cruelty: Promoting, facilitating, or depicting animal cruelty in violation of RA 8485 and RA 10631 (Animal Welfare Act, as amended).
• Harassment and abuse: Threatening, harassing, intimidating, or abusing other users through inquiries, reviews, or any platform feature.
• Impersonation: Impersonating any person, entity, or organization, or misrepresenting your affiliation with any person or entity.
• Multiple accounts: Creating or operating multiple accounts to circumvent bans, rate limits, review restrictions, or other platform safeguards.
• Scraping and automated access: Using bots, crawlers, spiders, scrapers, or other automated means to access, collect, or extract data from the platform without our express written permission, in violation of RA 10175 (Cybercrime Prevention Act of 2012).
• Security circumvention: Attempting to bypass, disable, or circumvent platform security measures, rate limits, authentication systems, or content moderation controls.
• Illegal purposes: Using the platform for any purpose that violates Philippine law or any applicable local, national, or international regulation.
• Defamatory or obscene content: Posting defamatory, obscene, discriminatory, or otherwise objectionable content.

5. Trust, Safety, and Reporting

5.1 Trust Levels

We operate a trust level system to help maintain platform quality. Users begin at the "NEW" trust level. Breeders may be elevated to "VERIFIED" status after admin review. Users who violate these Terms may be assigned a "BANNED" status. Trust levels affect listing approval workflow and platform privileges.

5.2 Reporting

Users may report listings or breeders they believe violate these Terms or applicable law. Reports are reviewed by our moderation team. We take reports seriously but make no guarantee regarding the timeline or outcome of any review.

5.3 Content Moderation

We reserve the right to review, approve, reject, or remove any content on the platform at our sole discretion, with or without notice. We employ both automated flagging systems and human moderation. Moderation decisions are final.

5.4 No Guarantee of Safety

Despite our trust and safety measures, we cannot guarantee the legitimacy, identity, or good faith of any user. We cannot guarantee that all listings are accurate, that all breeders are reputable, or that all transactions will be satisfactory. Users interact with each other at their own risk.

6. User Responsibilities and Due Diligence

6.1 Buyer Responsibilities

As a buyer, you are solely responsible for exercising due diligence before any transaction. We strongly advise you to:

• Inspect animals in person before purchasing. Never purchase an animal sight-unseen based solely on listing photos.
• Verify seller identity and ownership — confirm the seller is the actual owner or is duly authorized to sell.
• Request veterinary health certificates and vaccination records from the seller and verify their authenticity.
• Verify pedigree and bloodline claims — request supporting documentation for any claims about breed purity, lineage, or genetic quality.
• Never send money without physically meeting the seller and inspecting the animal first.
• Be cautious of below-market prices or pressure to pay immediately — these are common indicators of fraud.
• Understand breed requirements — research the specific care, feeding, housing, and biosecurity requirements of the breed you are purchasing.
• Obtain a BAI shipping permit if you will be transporting the animal across provincial or regional boundaries.
• Consult a licensed veterinarian for independent health assessment before finalizing any purchase.

6.2 Breeder Responsibilities

As a breeder, you are responsible for:

• The accuracy and legality of all information in your listings, including breed, age, weight, health status, and pricing.
• Disclosing known health issues, genetic defects, and disease history — including any history of African Swine Fever (ASF), Porcine Reproductive and Respiratory Syndrome (PRRS), or other reportable diseases in your stock.
• Compliance with all applicable laws and regulations, including RA 8485 and RA 10631 (Animal Welfare Act), RA 9296 (Meat Inspection Code), BAI registration requirements for commercial animal facilities, and all applicable LGU ordinances.
• Responding to buyer inquiries in good faith and with honest information.
• Not collecting personal information from buyers for purposes unrelated to the transaction.
• Maintaining proper animal welfare standards as required by law, including adequate housing, nutrition, veterinary care, and humane handling.

7. Limitation of Liability

8. Indemnification

You agree to indemnify, defend, and hold harmless PH Livestock, its owners, operators, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from or related to:

• Your use of the platform
• Your violation of these Terms
• Any listing you post or content you submit
• Any dispute between you and another user
• Your violation of any applicable law, regulation, or third-party right
• Any claim that your content infringes the intellectual property rights of others

9. Intellectual Property

The platform's design, code, user interface, graphics, logos, trademarks, and all other proprietary content are the exclusive property of PH Livestock and are protected under Republic Act No. 8293 (Intellectual Property Code of the Philippines) and applicable international intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works of any platform content without our express written permission.

User-submitted content (listings, photos, reviews) remains the intellectual property of the respective user, subject to the license granted in Section 3.3 of these Terms.

10. Prohibited Data Collection

You may not use any automated means — including bots, crawlers, spiders, scrapers, data mining tools, or similar technologies — to access, collect, copy, or extract data from the platform. This includes but is not limited to listing data, user profiles, photos, contact information, and pricing information.

Violation of this provision may constitute an offense under Republic Act No. 10175 (Cybercrime Prevention Act of 2012) and may result in immediate account termination, IP blocking, and referral to law enforcement authorities. We actively monitor for and take action against unauthorized automated access.

11. Dispute Resolution

11.1 Disputes Between Users

Any dispute arising from a transaction or interaction between users is strictly between those parties. PH Livestock is not a mediator, arbitrator, or party to any such dispute and bears no responsibility for their resolution.

11.2 Disputes with the Platform

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising from or relating to these Terms or your use of the platform shall first be resolved through good faith negotiation. If negotiation fails, the dispute shall be submitted to the exclusive jurisdiction of the appropriate courts in the Philippines.

11.3 Reporting Illegal Activity

If you encounter illegal activity on the platform, you may report it through our reporting system. For matters involving criminal activity, you may also report directly to the following authorities:

• PNP Anti-Cybercrime Group (PNP-ACG) — for online fraud and cybercrime
• NBI Cybercrime Division (NBI-CCD) — for investigation of cybercrimes
• Department of Trade and Industry (DTI) — for consumer complaints and unfair trade practices
• Bureau of Animal Industry (BAI) — for animal welfare and livestock regulation concerns

12. Service Availability

We do not guarantee that the platform will be available at all times or without interruption. We reserve the right to modify, suspend, or discontinue any part of the platform at any time, with or without notice, for any reason, including maintenance, upgrades, or circumstances beyond our control. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the platform.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised "Last updated" date. For material changes that significantly affect your rights or obligations, we will provide prominent notice on the platform prior to the changes taking effect.

Your continued use of the platform after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the platform.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any disclaimers published on the platform, constitute the entire agreement between you and PH Livestock regarding your use of the platform. These Terms supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
